These Terms constitute a legally binding agreement between Bricostrat Labs LLP and you, which regulates your use of our website https://www.skillstr.me/ (“Website”) and upcoming mobile application (“App”). It is including all content, services, and functionalities provided through the Website and App (collectively, the “Services”). Throughout the document, Skillstr, Bricostrat Labs LLP, and company have been used interchangeably but they refer to the same legal entity, Bricostrat Labs LLP.

8.2 Power skills development requires significant personal effort, practice, and application in real-world scenarios. You acknowledge and agree that the ultimate responsibility for skill development lies with you, and that consistent effort and commitment are essential to achieving desired results.

8.3 While Skillstr provides structured content and training modules, individual progress and results may vary based on factors such as user engagement, effort, personal context, and external influences.

8.4 You agree not to use the Services for any illegal activities, and you will comply with all applicable laws and regulations in India.

8.5 You agree not to:

• Engage in unauthorized framing or linking of the Services.
• Upload malicious software, such as viruses, to the Services.
• Use automated means (e.g., bots) to access the Services.

8.6 The Services offered by Skillstr aim to use AI-driven tools in the mobile app to personalise skill development. By using the platform, you agree to the collection and processing of your data to tailor recommendations and learning paths. Our AI operates based on data inputs but does not guarantee specific outcomes. Any decisions or actions taken based on AI recommendations are at your discretion. 8.7 AI Bias and Accountability: While we utilise AI in our services, Skillstr is not liable for decisions influenced by inherent biases in AI algorithms. We continuously monitor and improve AI fairness.

9.1 The Services provided by Skillstr are intended for educational and informational purposes only. While we strive to provide high-quality content, Skillstr makes no guarantees or warranties that the use of the Services will lead to specific career advancement, professional success, or personal improvement as it depends on users.

10.2 Skillstr certifications are intended to demonstrate the completion of training within the platform.

11.1 Skillstr is a brand operated by Bricostrat Labs LLP. Any use of the Skillstr name, logo, trademarks, or other identifiers without prior written consent is strictly prohibited.

11.2 You may not use the name of Skillstr, Bricostrat Labs LLP, or any associated logos or marks in any way that implies partnership, endorsement, or affiliation without our express written permission.

11.3 Any misuse of the Skillstr brand or attempts to create confusion in the marketplace by using similar names, logos, or branding will be subject to legal action under applicable trademark laws, including but not limited to the Trademarks Act, 1999.

12.1 In the course of providing the Services, Skillstr may recommend or integrate third-party tools, platforms, or resources (such as video conferencing, productivity tools, or other educational resources). You acknowledge and agree that the use of such third-party tools is governed by the terms and conditions of the respective providers.

12.2 Skillstr is not responsible for the content, availability, or performance of any third-party tools or platforms, nor any damage or loss resulting from their use.

13.1 Any feedback, testimonials, or success stories provided by users are voluntary and represent individual experiences. These testimonials are not indicative of typical results, and Skillstr makes no representations that other users will achieve similar outcomes.

13.2 By submitting feedback or testimonials, you grant Skillstr a non-exclusive, royalty-free, and perpetual license to use such content for promotional purposes, including on the Website, App, or any other media. 

13.3 Along with the testimonials, the logos of other brands displayed on this website are for illustrative purposes only and are the property of their respective owners. They represent the organisations associated with those giving the testimonials. The inclusion of these logos does not imply any official affiliation, endorsement, or partnership with the companies represented. 

14.1 To the maximum extent permitted by law, Bricostrat Labs LLP will not be liable for any indirect, incidental, or consequential damages, including loss of profits, arising from the use of the Services.

14.2 In no event will our liability exceed the amount you have paid for the Services in the preceding 12 months.

15.1 Skillstr reserves the right to terminate or suspend your account or access to the Services at its discretion, particularly in cases of breach of these Terms, misuse of the Services, or behaviour that may harm the platform or other users.

15.2 Upon termination, you will lose access to any content or services, including your progress, certification, and any unused paid services. No refunds will be provided in the event of termination due to user misconduct or violation of these Terms.

16.1 You agree to indemnify and hold harmless Bricostrat Labs LLP, its employees, and affiliates from any claims or liabilities arising from your use of the Services or breach of these Terms.

17.1 These Terms shall be governed by the laws of India, without regard to conflict of laws principles.

17.2 Any disputes arising out of or relating to these Terms or the Services shall be subject to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bengaluru, Karnataka, India.

18.1 Bricostrat Labs LLP reserves the right to modify these Terms at any time. Changes will be posted on this page with the "Last Updated" date reflecting such changes.

19.1 Skillstr is a brand name operated by Bricostrat Labs LLP, a limited liability partnership registered under the Limited Liability Partnership Act, 2008 with a separate LLP agreement between partners and registered office at in 1st Block Koramangala, Bengaluru 560034, Karnataka, India.

20.1 Bricostrat Labs LLP reserves the right to assign or transfer its rights and obligations under these Terms to any third party, including but not limited to, in the event of a merger, acquisition, or sale of assets.

20.2 Users will be notified of such a transfer and may choose to terminate their accounts if they do not agree to the new terms of the assigned party.
